EACC MOORINGS POLICY
EACC leases a plot on the River Thurne as its sailing base for Club regattas, as moorings for annual lease and as an occasional mooring for all members.
The annual lease moorings shall be under the direction of the EACC committee but the general management and the day-to day running of the moorings shall be delegated to a Moorings Officer appointed annually by the committee.
The Moorings Officer shall be required to:
(i) Allocate berths according to an agreed criteria (see below)
(ii) Ensure that maximum usage is made of the moorings to ensure an income to the Club commensurate to 90% of the cost of their upkeep over a five year period
(iii) Maintain a waiting list of members wishing to use a Club berth and allocate vacant berths, as far as is possible, in strict order of position on the waiting list. When a vacancy occurs the Moorings Officer shall notify the Skipper of the vacancy and of the next person on the waiting list. Where the Skipper feels that the berth should be offered to a person other than the next on the list the matter shall be referred to the committee for a decision.
(iv) Ensure, with the assistance of other Club members, that the site is maintained to a good standard to reflect the public face of the Club, that maintenance equipment is annually serviced and to organise site work parties as appropriate.
(v) To report annually to the committee, in writing, detailing the income received, the costs incurred and the need for any maintenance provision.
The Moorings Officer shall allocate berths according to the following order of precedence:
(i) Members who have held a berth in the previous season
(ii) Members who are on the official Club waiting list
(iii) Other Club members
(iv) Non-members of the Club. These berth holders will be required to pay a fee double that of a Club member.
The committee, through their Moorings Officer, lease their moorings on the following conditions:
(i) The safety of the boat and dinghy and their entire management, including insurance, shall be the sole responsibility of the owner/user. The Club shall not be responsible for any loss, damage, death or personal injury, howsoever caused, to the owner/user, his skipper, crew, guests, passengers or visitors as a result of their usage of the moorings and associated facilities.
(ii) All craft using the moorings shall be adequately insured; this insurance to include liability against third party risks
(iii) All persons using the moorings will be expected to comply with the local bye-laws.
(iv) Boats are permitted to use the moorings between 1st March and 31st December each year.
(v) All persons using the moorings are expected to extend every care and consideration to the village and its residents, especially in respect of car parking and dinghy slippage. Cars may be parked, by kind permission of Mr Roll, under the fruit trees and beside the barn almost directly opposite to the Methodist Chapel.
(vi) All persons using the moorings will be expected to avoid excessive noise
(vii) No work, other than minor maintenance and running repairs, is to be carried out on the moorings
(viii) All refuse must be removed from the site as soon as is possible
(ix) No fires are permitted. Where disposable barbecues are used these shall be supported on a stand so as not to cause damage to the grass
(x) Current berth holders, wishing to maintain a berth in the following season, shall indicate this by paying a deposit of £50 by the 15th December each year. This deposit will be deducted from their annual fee which will be payable by 31st March each year. In the event that they later decide not to renew their lease of a berth they will forfeit their deposit, unless the Club is able to fill the vacancy on the moorings from the Club’s waiting list or elsewhere.
(xi) The current rate, as from January 2009, for an EACC mooring is £11.50 per foot of boat length, the length to include bowsprit, boom overhang and any reasonable additional footage adjudged to be necessary.
(xii) The annual berth rate will increase annually by a minimum of the rate of inflation as judged by the published September CPI (the all items CPI excluding mortgage interest payments) each year. In exceptional circumstances the committee may decide to waive an annual increase.
(xiii) The moorings are let at a low rental which does not cover service and each user will be expected to help keep the site in good order by –
(a) maintaining the area around their mooring
(b) assisting with grass cutting of the main moorings site
(c) assisting with site work parties
(xiv) Although current berth holders will be given precedence each season in the allocation of berths, they must be prepared to move berths to enable the Moorings Officer to make the maximum income from the moorings. Such movement, although unlikely, may even occur during a season. Berth holders who feel that they are being unfairly treated in this respect may appeal to the committee.
(xv) The committee will use their best endeavours to ensure that there is an adequate depth of water on the moorings to ensure that they are accessible at all states of the tide, but they cannot guarantee this. In the event that any user consistently finds that there is insufficient water to use/moor his boat they should contact the Moorings Officer.
(xvi) EACC reserve the right to move any craft on the grounds of safety or expedience
(xvii) The committee will terminate a let, without a refund of the annual fee, if, in their opinion, the conduct of the berth holder has been to the annoyance of other Club members.
